Cirby Terms of Service

1. Definitions & Interpretation

In these Terms:

  • “Services” means all products, features, and functionalities made available through cirby.ai.
  • “User Content” means any text, files, documents, or materials you upload or generate using our Services.
  • “Subscription” means any paid plan or tier that grants access to features beyond the Free Tier.
  • “Beta” means pre-release software or features made available to a limited audience for testing.
  • Headings are for reference only and do not affect interpretation.

2. Changes to Terms & Notice

We may revise these Terms at any time. When we do, we will:

  • Post the updated Terms at cirby.ai/terms
  • Update the “Last Updated” date
  • Notify registered users by email and/or in-app notification of material changes

Your continued use of the Services after the Effective Date of any updated Terms constitutes acceptance of those changes.

3. Beta / Pre-Release Disclaimer

You acknowledge that certain features are in Beta and may be unstable or incomplete. We provide Beta features “as is,” and may modify, suspend, or discontinue them at any time without notice.

4. Introduction

These Terms constitute a legally binding agreement between you and Cirby (“Cirby,” “we,” or “us”). By accessing or using our Site and Services, you:

  • Acknowledge that you have read and understood these Terms and our Privacy Policy
  • Confirm you are at least 18 years old (or the age of majority in your jurisdiction) to use the Services. Individuals under 18 (or under the age of majority) are not permitted to use the Services. Cirby does not knowingly collect personal data from children under 18. If you believe we have collected such data, please contact us to request its deletion
  • Confirm you comply with all applicable laws and regulations
  • Agree to be bound by these Terms and our Privacy Policy

5. License to Use Our Services

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable license to access and use the Services for personal or commercial purposes in accordance with your subscription.

6. Intellectual Property Rights

6.1 Our Rights

Cirby retains all rights, title, and interest in and to:

  • The Cirby name, logos, and branding
  • The cirby.ai domain and associated subdomains
  • Platform architecture, design, and user interface
  • All proprietary code, features, and systems
  • Documentation, guides, and marketing materials

6.2 Your Rights

You retain ownership of your User Content. Cirby makes no claim to ownership of:

  • Text, files, or documents you upload
  • Outputs generated by the AI (resumes, cover letters, etc.)

You may:

  • Use generated content commercially
  • Modify, distribute, and export outputs without attribution

7. Data Usage, Privacy & Security

We collect and process personal data as described in our Privacy Policy.

8. User Accounts and Content

  • You are responsible for safeguarding your login credentials.
  • We may suspend or terminate accounts for Terms violations.
  • You warrant that you have the legal right to any content you upload.
  • You retain all intellectual property rights in your uploaded or generated content.

9. Feedback & License to Use

By submitting feedback, ideas, or suggestions (“Feedback”), you grant Cirby a perpetual, worldwide, royalty-free license to use, modify, and incorporate that Feedback into the Services without compensation or attribution.

10. Third-Party Services & Links

Our Services may integrate with or link to third-party platforms (e.g., LinkedIn, Vercel, OpenAI). We are not responsible for their terms, availability, or data practices.

11. Plans, Pricing & Subscription Terms

  • We offer Free and Paid tiers with defined feature limits.
  • Pricing and features may change with notice.
  • Subscriptions automatically renew unless canceled before the renewal date.

12. Cancellation and Refund Policy

  • Cancel anytime via account settings; access continues until period end.
  • Refunds are not guaranteed but may be issued for billing errors or duplicate charges.

13. Prohibited Uses & User Conduct

You agree not to:

  • Reverse engineer, decompile, or copy our Services
  • Use bots or automated systems without permission
  • Interfere with other users or overload the platform
  • Use the Services for unlawful purposes or to harm others
  • Circumvent subscription limits or create fake accounts
  • Sublicense, resell, or distribute the Services without our permission

14. DMCA Compliance

We respect intellectual property rights. For DMCA notices, contact support@cirby.ai with:

  1. Identification of the copyrighted work
  2. Identification of infringing material
  3. Your contact information
  4. Good-faith statement of infringement
  5. Statement under penalty of perjury

15. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties. We disclaim all implied warranties, including merchantability and fitness for a particular purpose.

16. Limitation of Liability

To the maximum extent permitted by law, Cirby’s total liability for any claim shall not exceed the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

17. Indemnification

You agree to indemnify and hold Cirby and its affiliates harmless from any claims, liabilities, or expenses arising from your use of the Services or violation of these Terms.

18. Dispute Resolution & Arbitration

All disputes arising out of or related to these Terms or the Services shall be resolved through binding arbitration. All arbitration shall be conducted on an individual basis; class, collective, and representative actions are not permitted. You waive the right to a trial by jury.


You may opt out of arbitration by written notice to support@cirby.ai within 30 days of first accepting these Terms. This clause does not prevent either party from seeking equitable relief.

19. Assignment

You may not assign your rights under these Terms without our written consent. Cirby may assign these Terms to an affiliate or successor.

20. Entire Agreement, Severability & Waiver

These Terms, together with the Privacy Policy, constitute the entire agreement. If any provision is invalid, the remainder continues in full force. Waiver of any term does not waive others.

21. Export Controls & Compliance

You agree to comply with all applicable export laws and not use Services in violation of U.S. or international restrictions.
